California's No Child Left Behind waiver request denied

Dec. 26, 2012

Dive Summary:

  • With the denial of its request for a waiver from No Child Left Behind, California will be forced to continue striving to achieve the 10-years-old, George W. Bush-era law's goals--which have been generally accepted as unachievable--and be punished for failing to meet them.
  • California was hoping to join the other 33 states that, along with the District of Columbia, have been given a reprieve, but its refusal to evaluate teachers based on students' standardized test performance was a sticking point on the state's application.
  • California Board of Education President Mike Kirst?said he anticipated the rejection, but blames Congress for failing to revise the law, which requires, among other things, that all students (including the learning disabled, poor and English learners) test proficient in English and math by 2014 and allows for punishment potentially as severe as firing a school's entire leadership and staff.

From the article:

Signaling that California again is marching to its own drum ? perhaps trailing the parade ? the federal government has denied the state?s request for a waiver from a key U.S. education law, thus assuring that schools will have to keep striving to meet what?s generally accepted as unachievable goals, then be punished for missing them.?Like other states, California had been hoping to win a reprieve from the restrictive provisions of the No Child Left Behind law. Among other terms, the law punishes schools and districts if not enough of their students reach proficiency in English and math. ...

Melvin Guillard survives Jamie Varner slam but loses UFC 155 bout

Melvin Guillard and Jamie Varner staked a late claim to the UFC 155 Fight of the Night bonus with a bout that ended in a split decision. Varner won it on the judges' cards, 30-27, 27-30, 29-28.

Varner gained an edge early in the bout by tagging Guillard in the first round. Guillard showed good kicks, but couldn't escape Varner's takedowns for much of the bout. But the most frightening moment of the bout came late in the third round.

[Complete UFC 155 recap: Cain Velasquez mauls Junior dos Santos]

The two were scrambling on the ground for position when Guillard took Varner's back. Varner stood up, and with Guillard's head pointed to the ground, Varner slammed his opponent to the ground. Amazingly, Guillard was not knocked out or injured from the move. The fight ended seconds after, and the two embraced.

?This was a very emotional fight for both of us," Varner said after the bout. "After what happened a few weeks ago at the "TUF Finale" event, we were both ready to compete. I knew we would eventually get in the Octagon and squash our beef and I definitely feel that we did. I?m happy about my performance, I feel that I was able to dominate the fight wherever we ended up and I?m glad I got the win.?

Varner and Guillard were originally scheduled to fight during "The Ultimate Fighter" finale on Dec. 15, but illness kept Varner from the cage. Guillard was understandably upset about the delay, leading to trash talk.

Hawaii lieutenant governor picked to fill Inouye's Senate seat

HONOLULU (AP) ? Hawaii's lieutenant governor spent time in the morning telling fellow Democrats why he should become the state's next U.S. senator. Hours later, he was hitching a ride to Washington with President Obama to be sworn in as the late Sen. Daniel Inouye's successor.

Gov. Neil Abercrombie appointed Lt. Gov. Brian Schatz to the post Wednesday, going against the dying wishes of Inouye, who wanted U.S. Rep. Colleen Hanabusa to take his place.

Schatz, 40, said his top priorities would be addressing global climate change, preserving federal funds used in Hawaii for things like defense spending and transportation, and getting federal recognition for Native Hawaiians in forming their own government, similar to many Indian tribes across the United States.

Schatz, who ran with Abercrombie for the state's top two offices in 2010, beat out Hanabusa and Esther Kiaaina, a deputy director in the state Department of Land and Natural Resources.

The three candidates were selected by state Democrats Wednesday morning from a field of 14. The candidates briefly made their cases before the state party's central committee, which handing the three top names to the governor.

"No one can fill Sen. Daniel K. Inouye's shoes, but what we want to do today is find the right person to walk in his footsteps," Schatz told the committee.

"I want to be your senator because I believe Hawaii needs seniority, and we need someone who can build it up over decades and decades. And I pledge to you, if I'm given this opportunity and obligation to serve, I will try to make this my life's work and rebuild the tenure that Hawaii so desperately needs," he said.

The White House said Schatz would fly to Washington Wednesday night with Obama, who was returning from his Hawaii Christmas vacation early as Congress considers what to do about the so-called fiscal cliff.

Schatz could be sworn in as early as Thursday, which would make him Hawaii's senior senator. Hawaii's other senator, Daniel Akaka, is retiring at the end of this Congress after 22 years.

Inouye, by far Hawaii's most influential politician and one of the most respected lawmakers in Washington after serving five decades in the Senate, died last week of respiratory complications at the age of 88. He sent Abercrombie a hand-signed letter dated the day he died, saying he would like Hanabusa to succeed him, calling it his "last wish."

Four days after eulogizing Inouye in the courtyard of the Hawaii Capitol, Abercrombie said he had to consider more than just Inouye's wishes in filling his seat.

"Of course Sen. Inouye's views and his wishes were taken into account fully, but the charge of the central committee, and by extension then myself as governor, was to act in the best interests of the party ... the state and the nation," Abercrombie said.

"The law makes explicitly clear, as do the rules of the Democratic Party, that while everyone's voice is heard and everyone's view is taken into account, nonetheless, no one and nothing is preordained."

Under state law, the successor had to come from the same party as the prior incumbent. An Abercrombie spokeswoman said the governor did not feel any political pressure from within his party to make the choice he made.

"While we are very disappointed that it was not honored, it was the governor's decision to make," Jennifer Sabas, Inouye's chief of staff, said in a statement. "We wish Brian Schatz the best of luck."

Selecting Hanabusa, 61, would have required a special election in Hawaii's 1st Congressional District. Last time that happened, Hanabusa lost to Republican Charles Djou because of a winner-take-all format that split votes between Democrats.

Abercrombie said the possibility of a special election was a factor, as well as Hanabusa's "key position" on the House Armed Services Committee. The governor said she was on her way toward establishing a senior position on that panel, and it's important for Hawaii ? with its four-member delegation ? to establish seniority in both chambers.

Schatz will serve until an election is held in 2014. He said he will run for re-election to try to keep the Senate seat until 2016 ? the end of Inouye's original term ? and would run again for Senate in 2016 if given the chance.

"To the people of Hawaii, I can assure you this: I will give every fiber of my being to doing a good job for the state of Hawaii," Schatz told a news conference in Honolulu. "We have a long and perhaps difficult road ahead of us, but we can succeed if we work together. I understand the magnitude of this obligation and this honor, and I won't let you down."

Hanabusa congratulated Schatz in a statement.

"Having served as chair of the Hawaii Senate Judiciary Committee when the succession law was passed, I fully respect the process and the governor's right to appoint a successor," she said.

Last week, when Abercrombie announced he would not seek the seat himself, his spokeswoman Louise Kim McCoy said Abercrombie intends to make his current post as Hawaii governor the last office of his political career.

Inouye would be "very happy" with the choice, Hawaii Democratic Party chairman Dante Carpenter said. Schatz has less experience than some older politicians in the Senate but he will be building seniority, which is "critical" to the state of Hawaii, he said.

"In the words of Sen. Dan Inouye ? invoked more than once ? seniority in the United States Congress is everything," Carpenter said.

Senate Majority Leader Harry Reid had urged Abercrombie to name Inouye's successor before the end of the year. The next Congress begins Jan. 3.

Democratic Rep. Mazie Hirono, D-Hawaii, was elected in November to succeed Akaka.

Schatz is a former state representative and former state Democratic party chairman. He also was a leader of Obama's campaign in Hawaii in 2008.

Even before winning the 2010 general election, Abercrombie expressed faith in Schatz, saying he would put him in charge of attracting more private and federal investment in Hawaii. Other responsibilities included leading the state's clean energy efforts and Asia-Pacific relations.

First in line to replace Schatz as lieutenant governor is Senate President Shan Tsutsui, who said he planned to discuss the prospect with his family before deciding.

DC hotels less busy for Obama's 2nd inauguration

WASHINGTON (AP) ? Visitors coming to the nation's capital for President Barack Obama's second inauguration can't stay in the one place President Ronald Reagan's family once called an eight-star hotel. That spot is the White House, and it's booked for the next four years. Still, inauguration-goers have a range of lodging options ? from crashing on a friend's couch to rooms that cost thousands of dollars a night.

With second inaugurations tending to draw fewer spectators, finding a place to stay in Washington won't be nearly as difficult as in 2009.

City officials are expecting 600,000 to 800,000 visitors for the Jan. 21 inauguration, far less than the 1.8 million people who flooded the National Mall four years ago to witness the inauguration of America's first black president. Back then, some hotels sold out months in advance and city residents rented out their homes for hundreds of dollars a night. This time, hotels say they're filling up more slowly, with rooms still available and prices at or slightly below where they were four years ago.

"Very few hotels are actually sold out at this point, so there's a lot of availability," said Elliott Ferguson, CEO of the tourism bureau Destination DC, who added that he expected demand to pick up after Christmas.

In 2009, hotel occupancy in the city for the night before the inauguration was 98 percent, and visitors paid an average daily rate of more than $600 that night, according to STR, a company that tracks hotel data. This time, some hotels still have half their rooms available. As a result, some establishments have relaxed minimum stays from four nights to three and could drop prices closer to the inauguration if demand does not increase.

Despite the muted enthusiasm, many of the city's posh hotels are still offering pricy packages. Visitors with an unlimited budget can check in to accommodations almost as grand and historic as the White House.

At The Willard hotel, about a block from the White House, rooms were still available starting at more than $1,100 a night with a four-night minimum. That means every guest will pay more than President Abraham Lincoln did when he checked out after his 1861 inauguration and paid $773.75 for a stay of more than a week.

At the Park Hyatt hotel in northwest Washington, where rooms start at $849 a night with a four-night minimum stay, the presidential suite is still available. For the 57th presidential inauguration next month, the hotel is charging $57,000 for a four-night package in the suite that includes butler service. And no one has yet booked $100,000 packages at the Fairmont hotel or the Ritz-Carlton.

A number of the city's luxury hotels plan special treats for guests, some of whom will be paying two to five times as much to stay during the inauguration compared with staying in the same room a week before. At the Ritz-Carlton, for example, where rooms start at about $1,100 per day, guests will get to bring home commemorative pillowcases embroidered with the official inauguration seal and their initials.

There are options for visitors looking to spend less, too, though some wallet-friendly choices have filled quickly.

Rooms at HI-DC, a hostel in downtown Washington, were sold out the day after the Nov. 6 election, with a bed in a dorm room going for $50 a night and private rooms for $150. With all the rooms sold, the hostel is finalizing plans for an election trivia night for guests.

Aunt Bea's Little White House, a six-room bed and breakfast in northeast Washington, still had two rooms available the week before Christmas, with rates starting at $225 a night. Innkeeper Gerald Duval said that included a bottle of champagne and a commemorative coin. There'll also be red-and-white bunting on the home's porch along with cutouts of the president and first lady.

Farther from downtown, the Best Western Plus hotel in Rockville, Md., was about 80 percent full with rooms at about $180 a night, down from a $209 starting rate. Director of Sales Ron Wallach said the hotel targeted some groups before the election, including students, journalists and the Secret Service, in order to fill its rooms.

Other travelers looking for budget-friendly prices may have success with websites like Craigslist or Airbnb, where homeowners offer their places for a price. More than 200 Craigslist housing posts in the area included the word "inauguration." Airbnb said it expected approximately 2,000 people to stay in Washington during the inauguration using its site.

Other travelers have told friends and family living in the area to plan on having guests. Lauren Hines and her husband had three people stay at their small Capitol Hill apartment during the 2009 inauguration, so many that one slept in a hallway. She and her husband now live in nearby Alexandria, Va., and planned to host her father-in-law, and maybe mother-in-law, from Ohio. Hines said they didn't even consider a hotel.

"They know that they've always got a place with us," she said.

Weird Science 2012: Sex, drugs and doomsday

Videos from the University of California at San Francisco show how researchers studied the alcohol consumption habits of lovelorn fruit flies in one of 2012's weirdest experiments.

By Alan Boyle

Sex, drugs, rock 'n' roll and the Apocalypse: 2012 had it all. But only 10 stories about the past year's strangest scientific research can make it into our Weird Science hall of fame???so we're going to need your help.

Past winners of the Weird Science Awards include glow-in-the-dark kittens and puppies, a 2,700-year-old marijuana stash, meth-crazy fruit flies, reattached rabbit penises and the corpse-dissolving machine. The Maya apocalypse came in for honorable mention last year?and the year before, but this could be an even bigger year for end-of-the-world weirdness.

There are lots of other contenders from 2012, however. It's hard to beat the story about the sex-starved flies who drowned their sorrows in alcohol while researchers watched. That covers sex and drugs. It also can make you feel sorry for the scientists who had to watch all that fly-sized heartbreak. (They might want to compare notes with the researchers who studied why alcohol makes people feel good.)

The sixth annual Weird Science Award competition follows the precedent we've set in past years: We offer up 30 nominees from the past year, and it's up to you to pick the top 10. We've included one of the studies that won an?Ig Nobel award. honoring for "research that makes people laugh ? and then think." That's a fine criterion for the Weirdies as well. Or you can go with research that makes you laugh ? and then makes you wonder, "What on earth were they thinking?"

Write-in votes and second-guessing are encouraged; you can register them in your comments. If a write-in vote gets enough support from commenters, the research in question will be added to the ballot.

The 10 nominees that get the most votes as of noon ET Jan. 2 will be the 2013 winners of the Weirdy Awards. Later that day, we'll discuss this year's crop of weird science with Ig Nobel creator Marc Abrahams on "Virtually Speaking Science," a talk show that plays out on the Web and in the Second Life virtual world. Tune in at 9 p.m. ET Jan. 2.

Apple lands important SIM card connector patent

Apple lands important SIM card connector patent

Sometimes, a patent grant is less about the technology itself than what it could mean for others. Case in point: a newly granted Apple patent for a "mini-SIM connector." The design complements earlier work and represents a straightforward approach to a SIM slot that prevents damage from inserting the card the wrong way and ejects the card through a plunger system. By securing the patent, however, Apple gains a bargaining chip in phone technology disputes, especially for SIM-related tussles; companies are less likely to start a fight if Apple can return fire. The claim doesn't give Apple a lock on subscriber modules by any means, but it could lead to other adopters treading carefully.

Three Speeds of Self Improvement - Tynan

Yesterday I got a good question from a reader. His email was too long to paste in full, but the gist of the question was that he was trying to do a lot of self improvement stuff at once, and his attention seemed to be too spread to really made a big impact in any one area. How do I manage to make a lot of progress, he asked?

Over the past dozen years or more I've tackled a huge number of self improvement projects. Not all of them have been complete successes, of course, but generally I've been satisfied with my progress. Through that time I've come to classify these projects into three different categories, which helps me coordinate them all.

The first category of self improvement projects are instant changes, which I wrote about here. These are mainly habits that binary, meaning that whether or not you're doing them is very easily measured. Either you're waking up early in the morning or you're not, either you're smoking or you're not, either you're eating healthy or you're not. The process of tackling these sorts of improvements is easy-- you come up with a compelling reason why you MUST switch ("If I don't quit smoking, I will die ten years early and miss seeing my grandchildren") and then you just do it. We have a natural inclination to draw these things out and make them into big deals, tapering them and scheduling them, but I find it much easier to just start now and do it completely. The biggest changes I've made in this category are waking up early, always being on time, and not eating unhealthy food.

When attempting instant changes, do one at a time unless two are complementary. For example, you could quit soda AND sugary food since they're related, but I wouldn't try qutting sugary food and waking up early at the same time. Will power is a strong force and can be harnessed for really impactful permanent change, but it works best with its attention undivided. So make a big instant change, wait 20-30 days or so until it's effortless (possibly more for some habits) and then move on to the next one.

The second category is long term gradual change. Here I'm talking about lifelong bodies of knowledge that you accumulate which end up shaping you, or personality characteristics that you develop over a lifetime. The distinguishing feature of these changes isn't that they MUST be done over a lifetime, but simply that they can be. A great example might be financial habits.

While you could tackle small subsets of the problem as instant changes ("I will save and invest $500 every month!"), the real benefit comes from a lifetime of learning and gradual improvement. Other examples would be conversation skills, optimism, or physical fitness. Multiple long term changes can be done concurrently because they don't require too much focus. If you read one book a month about conversation skills and related topics, and keep some of what you learn in mind while you go through your everyday life, you'll become a better conversationalist as you age.

Despite long term gradual changes being the least glamorous of the changes, I think that they might be the most important. Although all three categories are applicable, the post I wrote about always getting better is mainly about these sorts of changes.

The last category is focused change. In my life these tend to be short or medium term projects. Focused change projects are things like learning a language, learning to program, and learning pickup. You can tell that something is a focused change project and not a gradual change project when you realize that you won't get anywhere unless you go really hard on it for some period of time. One Italian tape a week for three years will leave you never speaking Italian, but doing ninety tapes in ninety days will leave you with a lifetime of SOME understanding and speaking Italian.

Most people, especially those who are really into self improvement, will try to do many focused change projects at once. I've tried this too, but it doesn't really work. In my experience, the best strategy is to have one and only one focused change project at a time. Always be working on something, but never work on more than one. From February to March this year, mine was pickup. Then I quit that and started taking violin lessons. Once I got to where I wanted to be in violin, I stopped that and started working on learning Chinese. If I had tried to do all three of these things at once, I doubt I would have gotten anywhere. Instead I focus on one at a time, switch it to gradual improvement once I've developed a base competency, and then focus on the next one.

When you use this three-tiered system, you can get a lot done in a short amount of time. In the past five months, while I brushed up on my pickup skills, learned to play the violin, and started to redevelop my Chinese, I also made several instant changes. I began waking up early (7:20am with no alarm today), being on time to everything, using a todo list, drinking tea every morning, flossing every night, taking vitamins every day, reaching out to one person every day, tracking my time, reading every day, and analyzing my day every night. For long term gradual changes, I've read several books on conversation, continued to practice poker, begun to read some fiction to train my mind to write fiction, become a better programmer, learned to cook a few new things, learned a few handyman skills, and become a better motorcycle rider.

Humans have an incredible capacity for self improvement, but unless it's coordinated properly and kept on pace, we risk overloading ourselves or slacking off completely. By understanding the three speeds of self improvement we can tackle a lot at once and lock in permanent changes as we move along.

Russian prosecutors seek innocent verdict in Magnitsky's death

MOSCOW (Reuters) - Russian prosecutors on Monday dropped their accusations against the only person being tried in connection with the prison death of anti-corruption lawyer Sergei Magnitsky, asking a court to find a former prison official not guilty.

The surprise move in the trial of Dmitry Kratov came in the midst of a row between Moscow and Washington over U.S. legislation meant to punish Russians seen as linked to the death of Magnitsky and other alleged human rights violations.

If the court clears Kratov, a former deputy head of a jail where Magnitsky spent part of a year, it will fuel accusations by Kremlin critics that the Russian government has no intention of seeking justice in a case that has blackened Russia's image.

"We have not determined what happened, and the biggest tragedy here is that ... this may have been our last chance to ask questions" of people who may have been involved, said Dmitry Kharitonov, a lawyer for Magnitsky's widow and family.

U.S. President Barack Obama on December 14 signed a law known as the Magnitsky Act, which directs his administration to bar accused Russian human rights violators from entering the United States and freeze any assets they have in U.S. banks.

Russia is retaliating with a bill expected to be approved by the upper house of parliament this week. It would apply similar measures to Americans accused of violating the rights of Russians and also bar Americans from adopting Russian children.

Magnitsky died in November 2009 after nearly a year in jail - the victim, former colleagues say, of retribution from the same police investigators he had accused of stealing $230 million from the state through fraudulent tax refunds.

His death caused an international outcry and Kremlin critics said it underscored the dangers risks run by Russians who challenge the authorities. The Kremlin's own human rights council said Magnitsky was probably beaten to death.

ROLE REVERSAL

Dmitry Medvedev, Russia's president at the time, fired several senior prison officials and ordered a investigation, but Kratov, charged with negligence, is the only person now on trial or facing trial in connection with his death.

State prosecutor Konstantin Bokov told the court there was no direct link between the actions of Kratov - who he said followed the rules of his job and had never received a health complaint from Magnitsky - and the lawyer's death.

The court is expected to rule on Friday on Kratov's guilt or innocence.

Kharitonov said a guilty verdict was still possible but unlikely, and he accused the prosecutors of avoiding testimony by several witnesses by saying last week that there was enough evidence for a guilty verdict and speeding the trial to an end.

"The prosecutors essentially defended Kratov, rather than prosecuting him," he said in an interview on cable TV and internet channel Dozhd.

He said he believed Russian prosecutors want Kratov cleared to avoid any suggestion they themselves are culpable in the death of Magnitsky, which occurred after prosecutors backed efforts to keep him in jail on tax evasion charges.

Kharitonov said the prosecutors also wanted to ensure they were on the right side in the conflict over the new U.S. law.

"The easiest thing for the prosecutor's office to do is to say that nobody is guilty - and if nobody is guilty, then why is the Magnitsky Act needed?" the lawyer said.

He said Magnitsky's family would demand that the state continue investigating his death.

(AP) ? More messages of hope and solidarity poured into Newtown on Monday as the town prepared to observe Christmas Eve 10 days after the elementary school massacre that claimed the lives of 20 first-graders and six teachers and administrators.

Two dozen children and six adults arrived at town hall in the morning to deliver hundreds of handmade cards and snowflakes collected as they toured the state in a charter bus.

One of the organizers, Gwen Samuel of Meriden, said "we just want them to know they're not alone in their journey."

The effort was intended to give Connecticut children a chance to express their feelings about the Dec. 14 shooting at Sandy Hook Elementary School.

Police say 20-year-old Adam Lanza killed his mother before going on the shooting rampage, then committed suicide. If they know why he shot his way into the school and gunned down 26 people, they have not said.

In the week since the shooting, messages similar to the ones delivered Monday have poured into Newtown from all over the world. People have donated toys, books, money and more.

"We know that they'll feel loved. They'll feel that somebody actually cares," said 15-year-old Treyvon Smalls of Middlebury, a few towns away from Newtown. "It gives us all a chance to speak out."

As Treyvon and the students traveling with him delivered their notes, another group of roughly two dozen people met in the town hall auditorium for a prayer service that was as much therapy session as religious gathering. Attendees expressed their sorrow and fears and looked to each other for support as they talked about what happened.

The town hall has become a gathering point for those dropping off donations and in need of a place to congregate and find comfort in one another. A "'peace tree" created out of a log and adorned with a heart-shaped wreath, numerous peace signs and Christmas decorations sit in front of the town hall steps, where a large banner proclaims, "Together we birth a culture of peace."

Karen Pierce, one of the town hall's elected building managers, has been helping accept the deluge of donations and expressions of support that have been coming in all week.

"We've had people from all over the country. It is incredible, it's heartwarming, it's overwhelming. It's invigorating and exhausting," she said. "It's so uplifting and I believe that's what's been getting people through."

The town has been so inundated with donations for children that Pierce said she has redistributed some to other children dropping off their own notes and donations, saying that with their acts of kindness they too have qualified to be children of Newtown.

On Monday, she gave each of the children dropping off cards a golden stuffed monkey. She chose gold, she said, because it symbolizes a new dawn that everyone needs.

"At the same time we have this outpouring and we want to make sure we give respect for every phone call, every card, every gift, every flower, every kind word," she said. "And so that's one of the things that everyone in the community is trying to do is make sure while people are honoring us, that's the big question, how do you say to the world 'Thank you?'"

Later Monday, people throughout Newtown were expected to light luminaries outside in memory of those killed.

The idea was hatched by Nicole Russo of Fairfield, who has two nephews who attend Sandy Hook Elementary School and were unharmed. She decided to bring her neighborhood's Christmas tradition of lighting the way for Santa to Newtown.

"My husband and I were saying we feel so helpless, you know, we're 30 miles away and we're helpless," she said.

After a group of her friends got together and started a 'Luminaries of Love' outreach campaign, about 40,000 bags were donated for their project, with Yankee Candle donating 10,000 candles.

The free bags and candles were quickly scooped up on Sunday in a couple of hours with many people offering cash donations that could help fund the project in the future.

"I want to do it every year," Russo said. "We don't ever want to forget."

Little Big Crimes: Lighthouse, by S.J. Rozan

"Lighthouse," by S.J. Rozan, in Staten Island Noir, edited by Patricia Smith, Akashic Press 2012.

This is the second appearance in this space by my friend S.J. Rozan in the last two months.?

In the introduction editor Smith talks about something that happened at a Bouchercon a few years ago: a panel of writers were speaking about crime in New York City and a creative writing teacher complained that the kind of disrespect the panelists were showing for Staten Island was the reason her students there wouldn't write anything about the place they lived.?

I happened to be in the audience.? What Smith doesn't mention is that S.J., who was the first person to joke about Staten Island, not only apologized but offered to come speak to the teacher's class.? Not only a great writer, but a real mensch.

But that has nothing to do with this story, which is about Paul.? And as the first sentence tells us:

It sucked to be him.

Because ever since? he was fourteen Paul shares his skull with The Guys, three space aliens who tell him what to do and give him monstrous headaches if he disobeys.? The only way to quiet the voices in his head is to shoot heroin, and the only way? to get money for that is by breaking and entering.

That wouldn't be so bad except that sometimes he meets someone in the house he is burgling and then he has to hurt them.? And that's the bad part because The Guys like it.? And they want him to do more, and worse.

In this story Paul is planning to bust into a Tibetan museum.? And maybe, just maybe, he can find a kind of redemption there...

Xunlei CEO - Web 2.0 Asia Blog

Recalling the past ten years, Zou Shenglong, founder and CEO of Xunlei, concluded that premium subscription is the best consumer-facing business model for internet services, citing advantages it brings on cash flows, pricing power and building the overall platform (source in Chinese).

Founded in January 2003 and becoming?one of the leading download and video streaming services in China, Xunlei introduced the subscription model in 2009.?Till today, it has four million subscribers ? 1% of the user base, paying?RMB9.8 ($1.5) or RMB15 ($2.4) per month, to contribute approaching half of its total revenues.?The company expects to have 10 million subscribers in two to three years.

The revenues generated by subscriptions as a percentage increased from 2.4% in 2009 to 16.9% in 2010 and to 26.4% in the three months ended March?31, 2011, according to its?F-1 filing with SEC?in July 2011.

img:vip.xunlei.com

Different from premium services offered by western products, the package a Chinese service would offer must range way more widely than its core business.?Xunlei?s?includes 30 plus privileges, from premium download offerings to online gaming. Tencent is widely recognized as the creator of the subscription model for monetizing an internet service. From 2000 to now, Tencent?s QQ Membership, with 20-plus combinations of offerings,?has over 20 million subscribers. Contributing the first revenues to the company, the model still generates about 20% of the internet giant?s total revenues.

Xunlei acknowledged it modeled Tencent?s both in?gaming business and the subscription service. Zou Shenglong pointed out that it took six years for Tencent to get one million subscribers, thinking that must be a turning point for such a business. So he didn?t think it?s a coincidence when Xunlei?s subscriber growth accelerated after having gained one million sign-ups.

Zou also counts the membership model as the base for developing other transaction-based paid services, such as gaming his company started operating in 2008. He thinks two preconditions can have more users pay for more services: a powerful platform that can?have impact on?user behaviors and a paying user base.

?Unrealistic to make big money through video advertising?

Besides subscriptions and gaming, the third revenue source of Xunlei?s is online video advertising. But that? s not a good business, according to Zou, given the content costs. The company has spent hundreds of millions yuan each year on licensing copyrighted video content since 2007, trying to scale up an advertising-based business and promising to share revenues with content providers. Unexpectedly, video content prices skyrocketed in the next years when online video streaming services crowded the market. Though prices declined to be comparatively reasonable in this year, Mr. Zou said ?currently it?s unrealistic to make big money through video advertising?.

Its online advertising revenues as a percentage declined from 70.7% in 2008 to 51% as of March 31, 2011, as disclosed by its F-1.

Although most Chinese web services with large user bases, including?Sina Weibo?and?Youku, adopted the subscription model, Xunlei is one of the few that succeeds in making a considerable income there. While it?s proven that users would like to pay several yuan a month to speed up downloading or video streaming, it seems online video sites like Youku have difficulty in charging for accessing premium content ? or there is little to offer since fierce competitions make it really hard not to offer any video for free. As to?Sina Weibo?s subscription offerings, I really think they are just trifle features that should have been for free anyway. It may be too early to judge. Maybe that premium subscription model will still be workable for any web service when premium offerings and timing are right, as Zou Shenglong believes in.
